Terms of Service

BlueNote is operated by Hoist Studio, a sole proprietorship doing business as Hoist Studio ("we", "us"). These terms apply to therapists ("you") who use BlueNote to schedule, record, transcribe, and manage therapy sessions. By creating an account you agree to them.
1. What BlueNote is
BlueNote is a software tool for independent licensed therapists, provided by Hoist Studio. We provide scheduling, optional session recording, AI transcription and summarisation, and client management. We do not provide therapy, clinical supervision, or medical advice.
2. Who is responsible for what
- You are the licensed professional. You are the data controller for your clients' data. You are responsible for obtaining client consent, complying with the rules of your jurisdiction and professional body, and for any clinical decisions.
- We act as a data processor on your behalf. We provide the infrastructure, security, and AI processing described in our Privacy Policy.
3. Your eligibility
You confirm that you are a licensed mental-health professional authorised to practise in your country, and that you will only use BlueNote with clients you are legally permitted to treat.
4. Acceptable use
You will not:
- Use BlueNote to process Protected Health Information (PHI) of US-based clients. BlueNote is not HIPAA-certified.
- Record sessions without explicit client consent.
- Upload content you do not have the right to upload.
- Attempt to break, probe, or reverse-engineer the service.
- Use BlueNote for anything illegal, harmful, or abusive.
We may suspend or terminate accounts that violate these rules.
5. Cross-border practice
If you treat clients located outside your country of practice, you are responsible for verifying that you are licensed and insured to do so, and that the client's jurisdiction's privacy rules are respected. We surface advisories in the dashboard but they are not legal advice.
6. AI processing
Audio is sent to our AI provider only for the time needed to produce a transcript and summary. It is not used to train models. AI output may contain errors — you are responsible for reviewing transcripts and summaries before relying on them clinically.
7. Fees and billing
Paid plans are billed through our payment processor, Stripe. Payment details are handled directly by Stripe under their terms and privacy policy. Subscriptions renew automatically until cancelled. You can cancel, update your payment method, or download invoices from your Billing page. Our 30-day money-back guarantee is described in our Refund Policy.
8. Service availability
BlueNote is provided "as is" and "as available". We do not guarantee uptime, uninterrupted service, or that the service will be free of bugs. We will make reasonable efforts to keep it running and your data safe.
9. Limitation of liability
To the maximum extent allowed by law, our total liability to you for any claim related to BlueNote is limited to the greater of (a) the fees you paid us in the twelve months before the claim, or (b) one hundred euros (€100). We are not liable for indirect, incidental, or consequential damages, lost profits, or clinical outcomes.
10. Indemnity
You agree to indemnify and hold us harmless from any claim arising out of your use of BlueNote in violation of these terms, including claims brought by your clients or by regulators in your jurisdiction.
11. Termination
You can close your account at any time from the dashboard or by emailing us. We can suspend or terminate your account if you breach these terms. On termination you can export your data for a reasonable period before it is deleted.
12. Changes
We may update these terms. Material changes will be announced in the dashboard or by email at least 14 days before they take effect.
13. Governing law
These terms are governed by the laws of the Republic of Serbia. Any dispute will be resolved exclusively by the competent courts in Belgrade, Serbia.
